Sujoy Ghosh Cleared of Copyright Infringement Charges by Supreme Court
In a significant victory for filmmaker Sujoy Ghosh, the Supreme Court of India has dismissed the criminal proceedings against him in a copyright infringement case related to his 2016 film "Kahaani 2: Durga Rani Singh." The decision came after a Bench comprising Justices PS Narasimha and Alok Aradhe found the allegations lacking substance and failing to establish a clear comparison between the works in question.
Legal Battle Over Alleged Script Copying Comes to an End
The case originated from a complaint by Umesh Prasad Mehta, who claimed that his script titled "Sabak" had been plagiarized for Ghosh's film. However, the court noted that the complaint was vague and unsupported, with no concrete evidence of similarity between the scripts. Ghosh's counsel argued that the proceedings were a misuse of legal process, leading the Supreme Court to agree and dismiss the case.
Ruling Emphasizes Proper Judicial Consideration and Dispute Resolution
The Supreme Court highlighted the lack of judicial scrutiny in the case, pointing out that the complainant's witness statements failed to prove any copying of the script. Additionally, the court noted that the Screen Writers Association’s Dispute Settlement Committee had previously found no resemblance between the two works, a crucial detail not disclosed during the initial proceedings.
